LEGAL~It's Against the Law to Introduce a UAP as a Nurse

Dr. Offices and private clinics have gotten into the practice of introducing UAP's (unlicensed assistive personnel) such as Techs, Medical Assistants, Phlebotomists etc. as nurses.

Introducing a UAP as a nurse is against the law in the state of Texas. Most often times administrative staff will not understand this is illegal and will most often introduce their clinical staff as nurses. This happens often. In the state of Texas, it is illegal to use a nurse title if you are not a licensed nurse. According to the Texas Board of Nursing, Nurse Practice Acts. Furthermore, personnel may not use the title "nurses aide," "nurse assistant," or "nurse technician" or any other similar title unless they are practicing under the delegation of a registered nurse.

Therefore, it is important you use the appropriate title for your scope of practice. If you are a UAP it is important to correct pt.s and staff members when they give you the title as a nurse and report this to appropriate personnel. If you are a licensed nurse staffed by a clinic it is important for you to call a meeting to address the issue. You must always adhere to Nurse Practice Acts and work within your scope of practice.
